Terms & Conditions

These Terms and Conditions govern the relationship between Thanin Legal ("the Firm", "we", "us", or "our") and any individual or entity ("Client", "you", or "your") who engages our pension defence services. By contacting us, submitting an inquiry form, or entering into a formal engagement letter, you acknowledge that you have read and understood these terms. If any provision is unclear, please reach out before proceeding.
1 Definitions
"Agreement" means these Terms and Conditions together with any signed engagement letter or service agreement.
"Services" means the legal advisory, hearing preparation, and court representation services offered by the Firm as described on our website.
"Client" means any natural person or legal entity that engages or contacts the Firm for professional assistance.
"Engagement Letter" means a written agreement specifying the scope of services, fees, and other particular terms for a defined matter.
"Confidential Information" means any personal, financial, or legal information shared by the Client with the Firm in the course of an engagement.
"Website" means the Firm's online presence accessible at thaninle.sbs.
2 Acceptance of Terms
By engaging the Firm or using this website, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement under Thai law.
If you are acting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to this Agreement.
Use of our website for informational purposes does not itself constitute an engagement; a formal attorney-client relationship arises only upon execution of a written Engagement Letter.
3 Services
Thanin Legal provides legal advisory and representation services related to pension and provident fund matters under Thai law, including proceedings before the Labour Court and the Court of Appeal.
Our primary service tiers are as follows:
- Short Pension Counsel Session — a single advisory session reviewing the pension file and identifying appropriate next steps (฿2,100).
- Pension Hearing Preparation — preparation for administrative or tribunal hearings, including position statements and a hearing walk-through (฿9,500).
- Full Court Mandate with Continuity — comprehensive representation through Labour Court and, where applicable, the Court of Appeal, with a single senior advocate as lead (฿10,200).
The scope of any engagement is defined in the Engagement Letter. Services are available to clients in Thailand and to Thai nationals residing abroad whose matters fall under Thai jurisdiction.
4 Client Responsibilities
To enable the Firm to act effectively on your behalf, you agree to:
- Provide accurate, complete, and timely information and documents as requested.
- Notify the Firm promptly of any developments or changes in your matter.
- Attend scheduled consultations, hearings, or calls as agreed.
- Settle invoices within the timeframe specified in the Engagement Letter.
- Refrain from engaging other legal representatives in the same matter without prior discussion.
The Firm shall not be responsible for adverse outcomes resulting from delayed, incomplete, or inaccurate information provided by the Client.
5 Intellectual Property
All content on this website — including text, design, structure, and document templates — is the property of Thanin Legal and is protected under applicable Thai intellectual property law.
Legal documents, position statements, and written advice prepared by the Firm for a specific client matter remain the professional work product of the Firm. Clients receive a non-exclusive licence to use such documents solely for the purpose for which they were prepared.
You may not reproduce, distribute, or publish any of the Firm's work product without prior written consent.
6 Fees & Payment
Fees are denominated in Thai Baht (฿) and set out in the relevant service description and confirmed in the Engagement Letter. Published fees represent standard rates for the described scope of work.
Payment is expected in advance of the commencement of each service tier, unless otherwise agreed in writing. The Firm accepts bank transfer to the account detailed in the Engagement Letter.
If the scope of work expands beyond what was initially agreed, any additional fees will be discussed and confirmed with you in writing before additional work proceeds.
Fees paid for sessions already conducted are non-refundable. For multi-stage engagements, partial refunds may be considered where work has not yet commenced on a defined stage; this will be assessed on a case-by-case basis.
7 Confidentiality
The Firm treats all client communications and file contents as strictly confidential, consistent with professional obligations under the Lawyers Act B.E. 2528 and the Lawyers Council of Thailand's professional conduct rules.
Confidential information will not be disclosed to any third party without your consent, except where required by law, court order, or regulatory authority.
Confidentiality obligations survive the termination of any engagement and do not have a time limit.

9 Limitation of Liability
To the fullest extent permitted by Thai law, the Firm's total liability to a Client arising from any engagement shall not exceed the total fees paid by that Client under the relevant Engagement Letter.
The Firm shall not be liable for indirect, consequential, or incidental losses, including loss of income, loss of pension entitlement, or loss of business opportunity, even if the possibility of such loss was foreseeable.
Nothing in these Terms excludes liability for gross negligence, wilful misconduct, or fraud.
10 Indemnification
You agree to indemnify and hold harmless the Firm and its advocates from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of this Agreement, your provision of false or misleading information, or your use of the Firm's services in a manner inconsistent with applicable law.
11 Termination
Either party may terminate an engagement by written notice. Where termination is initiated by the Client, fees for work already performed remain payable.
The Firm reserves the right to withdraw from an engagement where continued representation would place the Firm in conflict with its professional obligations, subject to providing reasonable notice and facilitating an orderly handover of the file.
Provisions regarding confidentiality, intellectual property, limitation of liability, and dispute resolution survive the termination of any engagement.
12 Dispute Resolution
This Agreement is governed by the laws of the Kingdom of Thailand. Any dispute arising from these Terms or an engagement shall first be addressed through good-faith discussion between the parties.
If resolution is not reached within thirty (30) days of written notice of a dispute, either party may refer the matter to mediation under the Thai Arbitration Institute or to the competent courts in Bangkok.
The parties agree to submit to the exclusive jurisdiction of the courts of Bangkok, Thailand.
13 General Provisions
Entire Agreement. This Agreement, together with any signed Engagement Letter, constitutes the entire agreement between the parties with respect to the subject matter hereof.
Severability. If any provision is found to be unenforceable, the remaining provisions continue in full force.
Waiver. Failure to enforce any provision does not constitute a waiver of that provision or any other.
Assignment. You may not assign your rights under this Agreement without the Firm's prior written consent. The Firm may assign administrative responsibilities within its team.
Notices. Formal notices should be sent by email to [email protected] or by post to the Firm's address below.
14 Changes to These Terms
The Firm may update these Terms from time to time. Where changes are material, we will post a revised version on this page with an updated effective date. Clients engaged under an active Engagement Letter will be notified directly of any changes that affect their matter.
Continued use of the website or our services after the revised Terms are posted constitutes acceptance of the updated Terms.
